To discuss strategy with respect the following litigation: Taxpayers Concerned for Baldwin v. Town of Brookline, et al., Superior Court Case No. 1882-CV-01517 and Neighbors of Baldwin v. Town of Brookline and the Transportation Board of Brookline, Superior Court Case No. 1982-CV-00252, if an open meeting may have a detrimental effect on litigating position of the public body and the chair so declares”

EXECUTIVE SESSION TO DISCUSS COMPLAINTS OR CHARGES BROUGHT AGAINST A PUBLIC OFFICER (G.L. c. 30A, S. 21(a)(1)

Public Comment period for citizens who requested to speak to the Board regarding Town issues not on the Calendar.

Up to fifteen minutes for public comment on matters not appearing on this Calendar shall be scheduled each meeting. Persons wishing to speak may sign up in advance beginning on the Friday preceding the meeting or may sign up in person at the meeting. Speakers will be taken up in the order they sign up. Question of approving and executing the following documents related to the construction of the new Brookline High School Expansion located at 111 Cypress Street as well as certain improvements to the MBTA Brookline Hills Station:

• License for Entry: MBTA – 16043A granting access onto MBTA property

• Easement Agreement between MBTA and Town of Brookline

• Escrow Agreement between the MBTA, the Town of Brookline and the prospective escrow agent: Sherin and Lodgen LLP, to hold the Easement Agreement in escrow during construction

• Amendment to 1976 Parking Agreement removing Brookline Hills Station from the 1976 Agreement

• Conditional Assignment of MBTA Station Improvements Permits
